Welcome to Medkart24 ("we," "our," "us," or the "Company"). These Terms & Conditions ("Terms") govern your access to and use of the Medkart24 website, mobile applications, and related services (collectively, the "Platform"). Medkart24 is an online pharmacy and grocery delivery service operating in Bhubaneswar, Odisha, India.

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Platform or services.

2 Acceptance of Terms

By using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms apply to all visitors, users, customers, and others who access or use the Platform.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.

3 Eligibility

To use our Platform, you must be at least 18 years of age and legally capable of entering into binding contracts under applicable law. By using the Platform, you represent and warrant that you meet these eligibility requirements.

If you are using the Platform on behalf of a minor or another person, you confirm that you have the legal authority to do so and accept these Terms on their behalf.

We strive to provide accurate and up-to-date information about the products available on our Platform, including descriptions, images, ingredients, and usage instructions. However, product information is provided for informational purposes only and may not be complete or accurate.

We do not warrant that product descriptions, images, or other content on the Platform are accurate, complete, reliable, current, or error-free. If a product offered by us is not as described, your sole remedy is to return it in unused condition, subject to our Returns and Refunds policy.

7 Product Availability

All products on the Platform are subject to availability. We reserve the right to limit quantities of any products or services that we offer. We may discontinue any product at any time without notice.

In the event that a product you have ordered is unavailable, we will notify you and provide options for a replacement, backorder, or refund.

8 Prices and Payments

All prices displayed on the Platform are in Indian Rupees (INR) and are subject to change without notice. While we strive to provide accurate pricing, errors may occur. In the event of a pricing error, we reserve the right to cancel the order and refund any amount paid.

We accept various payment methods, including UPI, debit/credit cards, net banking, wallets, and Cash on Delivery (COD) on eligible orders. By providing payment information, you represent that you are authorized to use the chosen payment method.

All payments are processed through secure third-party payment gateways. We do not store your payment card details on our servers.

9 Orders and Order Acceptance

Placing an order on the Platform constitutes an offer to purchase the products selected. We reserve the right to accept or reject any order for any reason, including but not limited to product availability, pricing errors, or suspicion of fraudulent activity.

Order confirmation will be sent via WhatsApp or SMS. The contract of sale is formed only when we confirm dispatch of the order.

10 Order Cancellation

You may cancel an order before it is dispatched by contacting us via WhatsApp or phone. Once the order has been dispatched, cancellation may not be possible.

We reserve the right to cancel any order at any time due to unforeseen circumstances, including but not limited to product unavailability, pricing errors, or delivery restrictions. In such cases, a full refund will be issued.

11 Delivery

We currently deliver within Bhubaneswar and surrounding areas. Delivery times are estimates and may vary based on location, weather, and other factors. We are not liable for any delays in delivery.

Free delivery is available on orders above ₹499 within a 5km radius. Additional delivery charges may apply for orders below this threshold or outside the free delivery zone.

Someone must be available at the delivery address to receive the order. If delivery cannot be completed due to unavailability, the order may be returned to us, and a re-delivery fee may apply.

12 Returns and Refunds

Due to the nature of pharmaceutical and healthcare products, returns are accepted only in cases of damaged, defective, or incorrectly delivered items. You must notify us within 24 hours of delivery to be eligible for a return or refund.

For non-pharmaceutical products (grocery, personal care, etc.), returns may be accepted within 48 hours if the product is unopened and in its original packaging.

Refunds will be processed to the original payment method within 5-7 business days. Shipping charges are non-refundable unless the return is due to our error.

13 Pharmacy Products

Medkart24 is a licensed pharmacy operating in compliance with the Drugs and Cosmetics Act, 1940, and other applicable regulations. All prescription medicines are dispensed by registered pharmacists.

We do not encourage or facilitate the purchase of prescription medicines without a valid prescription. Prescription medicines may be dispensed only upon verification of a valid prescription from a registered medical practitioner.

Users are responsible for ensuring that any prescription uploaded or provided is valid, authentic, and issued by a licensed healthcare professional.

14 Prescription Requirements

Prescription medicines may require a valid prescription where applicable. By uploading a prescription, you confirm that:

• The prescription is valid, authentic, and issued by a licensed medical practitioner.
• The prescription is for your own use or for a person for whom you are legally authorized to obtain medicines.
• You will follow all applicable medical and legal requirements regarding the use of prescription medicines.

We reserve the right to reject any prescription that appears invalid, illegible, or suspicious. Our registered pharmacists will verify all prescriptions before dispensing.

15 User Responsibilities

You are responsible for:

• Providing accurate and complete information when placing orders.
• Ensuring that any prescription provided is valid and authentic.
• Using products in accordance with the manufacturer's instructions and applicable laws.
• Consulting a qualified healthcare professional before using any medication or treatment.
• Maintaining the confidentiality of your account credentials.

You agree not to use the Platform for any unlawful purpose or in any way that violates these Terms.

16 Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Platform for any illegal or unauthorized purpose.
• Attempting to gain unauthorized access to the Platform or its systems.
• Interfering with or disrupting the Platform's operation.
• Uploading or transmitting viruses, malware, or any harmful code.
• Collecting or harvesting personal information of other users.
• Impersonating any person or entity.
• Engaging in fraudulent or deceptive practices.

We reserve the right to terminate your access to the Platform if you engage in any prohibited activities.

17 Intellectual Property

All content on the Platform, including text, graphics, logos, images, software, and the compilation thereof, is the property of Medkart24 or its licensors and is protected by Indian and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any content from the Platform without our prior written consent.

The Platform may contain links to third-party websites or services that are not owned or controlled by Medkart24. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

19 Disclaimer

The Platform and all products and services provided through it are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied.
